VAWA Evaluations

This tool can be used when a relationship between citizen and non-citizen immigrant spouse becomes abusive. Immigrant spouse must be the victim in order to receive a professional evaluation that allows for a petition to be filed stating that non-citizen immigrant can remain in the U.S for without the abuser’s knowledge

U-VISA Evaluation and T-Visa

This evaluation may be included in the process of granting legal status to immigrants that have been victims of serious crimes in the U.S. In such cases, a U-VISA Evaluation assesses the extent of serious emotional, physical, and/or mental consequences of their experiences.

A T-Visa immigration evaluation is a psychological assessment conducted by a licensed mental health professional to support an individual's application for a T-Visa, a visa designated for victims of human trafficking. This evaluation documents the psychological and emotional impact of the trauma experienced due to trafficking. It helps provide evidence of mental health concerns such as PTSD, anxiety, depression, and other conditions resulting from the individual's experiences. The report can be used to support the legal case by demonstrating the need for protection and stability in the United States.

Extreme Hardship Evaluation

This is designed to document and articulate hardship (ex. Deportation) to immigrant professionals. Non U.S. citizens can complete this process of evaluation to show how the individual would suffer if admitted back/deported to their country.

FAQs

What is an immigration evaluation, and why is it needed?

An immigration evaluation is a comprehensive psychological assessment conducted to support individuals in legal cases such as VAWA, U-visa, hardship waivers, or asylum claims. It provides detailed information about your mental health, personal history, and how your immigration status or experiences impact your well-being. Attorneys use this report as evidence to strengthen your case in court.

How long does the evaluation process take?

The immigration evaluation process typically takes 2 to 4 weeks, depending on the complexity of the case, the client's responsiveness in completing required documents, and scheduling availability.

Here’s a general timeline:
Initial Consultation – Discuss your case and evaluation needs.
Document Completion – Client submits intake forms and assessment questionnaires.
Evaluation Session(s) – Conducted over 1-2 sessions, lasting 1.5 to 2 hours each.
Report Writing – The therapist prepares a comprehensive report (typically 7-10 business days).
Final Review & Submission – The client reviews and receives the final report to submit to their attorney.

What kind of information will be included in the evaluation?

The evaluation includes detailed information about your family history, work history, medical and psychiatric history, and your current mental health status. In some cases, a clinical diagnosis may be included to highlight the psychological impact of your situation. Any diagnostic information will be thoroughly explained and included only if necessary for your case.

Will the evaluator speak with my attorney?

Yes, if needed, the evaluator may consult with your attorney or paralegal to gather additional background information or clarify legal aspects of your case. This ensures that all necessary details are included in the evaluation and that it aligns with your attorney's strategy.
